The boy-racers have turned out to be chick­ens in the face of the law designed to crush their cars for repeat offend­ers. now the son of a mother who just yes­ter­day became a vic­tim of drunk dri­ving says crush drunk dri­vers cars.

The old­est son of a mother-of-five killed by a woman flee­ing a police check point says it’s time to crush drink-drivers’ cars.

Bradley Phillips said last night he was frus­trated by the Government’s eager­ness to crush boy rac­ers’ vehi­cles, while let­ting drink-drivers keep theirs.

His mother, Pene­lope Rae Phillips, 52, died in Blenheim on Fri­day night after a 20-year-old woman smashed into her car.

The woman had been stopped at a police check­point 400m away. Police said she blew a pos­i­tive result then sped away.

Offi­cers scram­bled to pur­sue, but the woman struck the white Nis­san Pene­lope Phillips was dri­ving. She died at the scene.

An inno­cent dri­ver killed by a drunk skank and the skank sur­vives. I feel for the son.

I read this story yes­ter­day after I saw the head­line on the Her­ald site that really rates as spam jour­nal­ism. The head­line read “Woman dies as dri­ver flees police” giv­ing the impres­sion that the woman was involved in a police pur­suit when noth­ing of the sort happened.

Just today we also hear that;

One of New Zealand’s worst repeat drink-drivers has been caught again, rack­ing up his 40th dri­ving con­vic­tion – 14 of them for drink-driving.

Richard Steven Rowe, 46, of the Bay of Plenty, is in cus­tody await­ing sen­tenc­ing in April for his lat­est drink-driving con­vic­tion. He faces up to two years’ jail and dis­qual­i­fi­ca­tion from dri­ving for more than a year.

How many chances does one get? Looks like more than 14 or so. Crush their cars. This is the result of another vagary of our jus­tice sys­tem, never being allowed to know what prior con­vic­tions a fool has already. Crush their cars.

I don‘t know about you Whale,but I am get­ting really slut­ted off with the media mak­ing the cops jus­tify their actions every­time some­cunt breaks the law and kills an inno­cent cit­i­zen or themselves.

And this Mum has a valid point ‚crush all cars of those con­victed of DUI, trou­ble is most politi­cians would prob­a­bly have to start catch­ing the bus and we could‘nt pos­si­bly have that.

Well said Cam – it WASN’T a Police pur­suit. It was a stu­pid deci­sion made by a young woman with a skin­ful; and it has had tragic con­se­quences for BOTH fam­i­lies. But the Police are an easy tar­get for lazy journalists.

As for the recidi­vist drunk dri­ver; a max­i­mum term of impris­on­ment, a life­time ban from dri­ving, and as a con­di­tion of his parole, a res­i­den­tial treat­ment pro­gramme for his pretty obvi­ous alco­hol addic­tion. If the law won’t allow any­thing more dras­tic for offend­ers such as Rowe, then it needs to be changed.

I’m sure theres some coun­try that drunk dri­vers get to blow the bag ‚if it’s pos­i­tive then they get shot on the spot.
It’s only going to take one check­point tele­vised live where every d.d. is shot to wreck to fry the situation.

The car will prob­a­bly be crushed any­way as it was prob­a­bly ‘totalled’ in the accident.

The young woman will be fac­ing a dan­ger­ous dri­ving caus­ing death charge if not a manslaugh­ter charge. The fate of her car would be the least of her wor­ries. She faces some fairly seri­ous jail time. Hope­fully the docs at the hos­pi­tal pulled some of her blood for analy­sis, but how much blood alco­hol is only rel­e­vant for sen­tenc­ing pur­poses in this case.

In cases such as this, if a jury is to return a ‘not guilty’ to manslaugh­ter, it should con­sider a ver­dict to dan­ger­ous dri­ving caus­ing death, and if ‘not guilty’ to that, then care­less dri­ving caus­ing death. At present the cops and Crown Law use a ‘points sys­tem’ to ecide whether to charge manslaugh­ter or dan­ger­ous dri­ving caus­ing death, the con­cern being that juries tend to have some aver­sion to ‘guilty’ ver­dicts for manslaugh­ter despite dan­ger­ous dri­ving caus­ing death being tan­ta­mount to manslaughter.

fair point. drink dri­ving is far more dan­ger­ous than boy rac­ing, plenty of mul­ti­ple offend­ers too.

i won­der how many peo­ple would run, if they new the car would be crushed. too bad.

40 drink dri­ving con­vic­tions is slightly exces­sive! This guy should be charged with 40 counts of attempted mur­der, and I think that if ever a case deserves pre­ven­ta­tive deten­tion, this is it. Pre­vent our fam­i­lies from being killed, and this guy from ever dri­ving again…better still, send him to Saudi Ara­bia they have the death penalty for this sort of arsehole
